Allison Fabyanske Eklund started Eklund Law, P.C. in July 2007 after two years in general litigation and seven years in the practice of Federal Indian law. Her exposure to a broad variety of legal issues supports a diverse solo practice in law, business consulting, and alternative dispute resolution.
In the arena of Indian law, Ms. Eklund has litigated in federal, state, and tribal court systems. She represented a tribal business in multi-state litigation over state regulatory encroachment, finally resolving the state court cases in a single federal court action. She also has represented a tribal client before the Environmental Appeals Board of the United States Environmental Protection Agency and the United States Courts of Appeals in a dispute over tribal regulatory jurisdiction and "treatment as a state" under the Clean Water Act. Ms. Eklund has represented tribal social services agencies in child protection cases pending in state and tribal courts and served as Special Appellate Counsel for a non-profit organization representing Indian parents and custodians in cases involving the Indian Child Welfare Act. Ms. Eklund's practice includes a focus on Indian land tenure, including land acquisition and title transfer issues, shepherding applications for fee-to-trust through the United States Department of Interior and Bureau of Indian Affairs, administrative appeals, and advising tribal clients to avoid or resolve regulatory and jurisdictional conflicts.
Ms. Eklund is an experienced family law attorney with a background in Indian child adoptions and third-party custody proceedings. She has represented parents, grandparents, and Indian tribes in a variety of contested child custody matters.
Allison Eklund's personal interest in horses and horseback riding has led to work with equestrian organizations such as riding stables, saddle clubs, and nonprofit therapeutic riding centers. Ms. Eklund also is an active painter and multimedia artist who enjoys consulting with artists and arts organizations.
Ms. Eklund's pro bono activities include service on the board of directors of Sugarloaf, the North Shore Stewardship Association (http://www.sugarloafnorthshore.org/) and the Gordon Nelson Memorial Foundation (http://www.gnfoundation.org/). She is a supporting member of the Grand Marais Art Colony and enjoys coordinating art workshops for a women's art group in the Twin Cities.
