Dan graduated from New York University School of Law in 1996. His practice at SPR includes a wide variety of environmental litigation before federal, state, and local trial and appellate courts and administrative bodies, and includes both civil and criminal matters. Reflective of the firm’s broad client base, Dan represents state and local governmental bodies, industrial and commercial clients, as well as individuals and local environmental organizations.
Dan litigates a broad variety of environmental disputes, ranging from complex Superfund (CERCLA or its state counterpart) matters, to RCRA claims alleging imminent endangerment, to Navigation Law claims arising out of petroleum spills, to proceedings either defending or opposing a project and its associated environmental review under the State Environmental Quality Review Act (SEQRA) and the National Environmental Policy Act (NEPA). In addition to litigation, Dan has brought numerous cases to resolution through alternative dispute resolution such as environmental mediation and arbitration.
Dan works with governmental agencies such as the New York City Department of Environmental Protection (DEP), the New York State Department of Environmental Conservation (DEC), and the Army Corps of Engineers to obtain environmental permits. He also counsels clients during the preparation of environmental impact statements (EISs) under both SEQRA and NEPA, working either for the applicant or for the reviewing agency, such as the Empire State Development Corporation. Among other projects, Dan worked on the environmental reviews for the Atlantic Yards development in Brooklyn, Columbia University's expansion in Manhattanville, the renovation of the Seventh Regiment Armory on Park Avenue, and the proposed NASCAR Speedway complex on Staten Island.
Dan assists clients in ensuring compliance with applicable environmental statutes, regulations, and permits including water discharge (SPDES) permits, petroleum bulk storage (MOSF) licenses, air (Title V) permits, Facility Response Plans, spill control (SPCC) plans, as well as homeland and port security measures. He also oversees audits of hazardous waste, water, air, and chemical and petroleum storage programs.
During law school, Dan worked at the United States Environmental Protection Agency (EPA) and later here at SPR. In 2002, Dan rejoined the firm after practicing as a litigator at both Schulte Roth & Zabel, where he focused on securities and real estate matters, and Squadron Ellenoff Plesant & Sheinfeld (now Hogan & Hartson) where he worked on trademark and antitrust matters.
Between 1999 and 2000, Dan served as a law clerk to the Honorable Jorge A. Solis, of the United States District Court in Dallas, Texas.
