Robert F. Elgidely specializes in the litigation of Bankruptcy, Construction, ERISA/Employee Benefits, Federal Taxation, and Real Estate disputes. Mr. Elgidely has significant experience representing single employer and multi-employer (Taft Hartley) employee benefit plans as well as their trustees, participants, and beneficiaries. He has litigated several ERISA/Employee Benefits and Federal Taxation issues in Bankruptcy Court, including the exclusion of employee benefits from property of the estate, employee benefit liabilities, preservation of net operating losses, dischargeability of taxes, and payment of trust fund liabilities.
Mr. Elgidely is a member of the American Bar Association, Tax Section, Employee Benefits Subcommittee, the Federal Bar Association, the Bankruptcy Bar Association for the Southern District of Florida, and the Broward and Miami-Dade County Bar Associations. He is also a member of the Board of Trustees for the Leukemia & Lymphoma Society of Southern Florida and Chairperson for its annual Man and Woman of the Year Campaign.
Mr. Elgidely is a member of the Florida and New York Bars and is admitted to practice before the U.S. Court of Appeals for the Eleventh Circuit, the U.S. District Courts for the Southern and Middle Districts of Florida, and the Southern, Northern and Western Districts of New York.
Mr. Elgidely received his Master of Laws in Taxation from the University of Miami School of Law in 1997, his Juris Doctor degree from Nova Southeastern University Shepard Broad Law Center in 1996, and his Bachelor of Arts in Political Science from Siena College in 1993. Mr. Elgidely won every trial competition in which he participated as a student member of the American Association for Justice and received the Krupnick, Campbell, Malone, Roselli, Buser & Slama Trial Advocacy Award. Mr. Elgidely also served as a Medic in the U.S. Army Reserve from 1988 to 1996.
