Recent Representative Cases
Neodesha v. BP. Most recently, David and the Edgar team represented the City of Neodesha, Kansas, Wilson County, Kansas, The Neodesha School District and all affected property owners in the area, in a property damage class action against BP. The case involved soil and groundwater pollution under the town's residences, schools and businesses, emanating from an oil refinery that was dismantled in 1970. The Plaintiffs are seeking damages in the hundreds of millions of dollars. The jury trial spanned twenty-two (22) weeks and is believed to be the longest trial in the history of Kansas. Following a disappointing result from the jury, the Edgar team filed a motion for judgment as a matter of law with the Court. The Court entered judgment as a matter of law in favor of our clients. BP has appealed that result. If affirmed by the Kansas Supreme Court, a damages trial will be held in the near future, where a jury will determine the precise amount of damages to award our clients.
Fitzgeralds and City of Sugar Creek, Missouri v. Station Casinos. David and the Edgar team represented a gaming company and a municipality in the Kansas City area, bringing suit against the successful applicant for license to operate a riverboat casino in Jackson County. The suit alleged various theories, including tortious interference with the business expectancy, fraudulent concealment and fraud by silence. A settlement was reached, as Station Casinos reported in its public filings with the Securities and Exchange Commission, and Station Casinos paid our clients $38 million.
Jury v. Squire Sanders & Dempsey LLP. David and the Edgar team successfully represented the redevelopers of Kansas City's historic President Hotel in a six-week jury trial against a Cleveland-based law firm, Squire Sanders & Dempsey LLP. Edgar Law Firm negotiated a $43 million settlement for their client.
