Marty Myers is nationally recognized for extensive experience in insurance recovery for technology-focused enterprises. He has obtained large recoveries in coverage and bad faith cases under a variety of insurance policies for technology product liabilities, data/equipment damage, securities fraud exposures, employment practices, software or program failure, business interruption, trademark, copyright, and patent and unfair competition losses in federal and state courts throughout the United States. Marty has obtained similar insurance recoveries for clients in other industries including real estate (developers, REITs, and owners), entertainment (music, gaming, and publishing), retail (consumer electronics, apparel, and catalog), food and beverage (dairy and convenience food), and securities/financial services (brokerages, investment banks, and venture firms). He is co-leader of Jones Day's Insurance Liability & Recovery Practice.
Marty also advises policyholders on complex insurance underwriting, loss prevention, and risk transfer situations. Clients consult him frequently on directors and officers policy questions and the insurance and contractual risk transfer provisions in mergers, acquisitions, and significant software and patent license transactions. He is among the world's leading practitioners in mergers and acquisition-related insurance, including tax loss, representation, and warranty environmental and finite risk policies. Prior to joining Jones Day, Marty was counsel in the placement of the largest tax loss insurance program in history (total limits excess of $325 million).
Marty also has been lead defense counsel in several notable securities and corporate litigation matters. He has obtained dismissal of his clients and established important principles of California law through published decisions. He serves as judicial arbitrator and mediator at the request of various California courts. He frequently is published and speaks to professional organizations on insurance recovery and other complex litigation matters.
