Mr. Miscioscia is a partner in the Commercial Litigation Department and member of the Business Insurance Practice Group and Environmental Coverage Practice Group. He has a broad range of experience in complex insurance coverage, bad faith and commercial litigation matters.
Mr. Miscioscia represents major property and casualty insurers and smaller regional insurance companies on both a national and regional basis. His practice includes representation in state and federal court, as well as in private arbitrations and mediations. He has handled insurance coverage and bad faith matters involving complex and emerging issues, including advertising injury/intellectual property, construction defect, legal, accounting and other professional liability, environmental liability, educator's legal liability, employment discrimination, and employee benefits coverage and bad faith litigation. He has also represented clients in litigation involving business and commercial disputes, including contractual indemnification, defamation and breach of contract claims.
Mr. Miscioscia has presented lectures to the insurance industry on topics ranging from advertising injury/intellectual property coverage to successor liability. He is a co-author of "Insurance Coverage for Cyberspace Claims", The Legal Intelligencer, August 28, 2000. He also co-authored a paper for the Federation of Defense and Corporate Counsel's 2004 annual meeting entitled "Liability Insurance Coverage for Construction Defect Claims", which was later published in the FDCC Quarterly, Summer 2005 edition. In 2005, 2006 and 2007, Mr. Miscioscia was named in a survey of his peers as a Pennsylvania "Rising Star" attorney by Law & Politics magazine.
