Monsees, Timothy W.

Elizabeth Mitchell is a partner in the firm's Securities and Litigation/Controversy Departments, and a member of the Securities Litigation and Enforcement Practice Group and the Business Trial Group. She joined the firm in 2001.

Practice

Ms. Mitchell has represented financial institutions, corporations, and individuals under investigation by the Securities and Exchange Commission, the Department of Justice, self-regulatory organizations, and state attorneys general in a variety of matters. She has also handled a range of civil litigation matters both within and outside of the securities context, with an emphasis on complex disputes at the trial level.

From 1999 to 2001, Ms. Mitchell served as a Trial Attorney in the Torts Branch of the United States Department of Justice. In this role, she represented the White House and numerous federal agencies in the government’s litigation against the tobacco industry.

• Representation of hedge fund in parallel SEC and Justice Department investigations into alleged insider trading.
• Representation of hedge fund in New York Attorney General investigation into the fund’s use of paid research consultants.
• Representation of a senior public official in parallel SEC and Justice Department investigations into trading activity.
• Representation of broker-dealers in connection with NASD/FINRA investigations of mutual fund and variable annuity sales and trading practices.
• Representation of the Audit Committee of the Board of Directors of a large multinational public company in its internal investigation and related SEC investigation of accounting irregularities.
• Obtained on behalf of a pro bono client, and successfully defended on appeal, a $415,000 judgment against a foreclosure specialist for unfair trade practices.
• Defending a major insurer in a bankruptcy case involving a four-week trial and billions of dollars of asbestos liabilities.
