Howard B. Miller served in 2009-2010 as the 85th President of the State Bar of California.
He specializes in the areas of patent, copyright and other intellectual property litigation, anti-trust, and general complex commercial litigation. Among his many successful cases, his patent cases have included outstanding results in technologies as different as cancer radiation therapy and GPS location technology for cell phones.
He successfully argued one of the most important recent U.S. intellectual property cases, Montz v. Pilgrims Films and NBC Universal, 649 F.3d 975, (9th Circ., 2011), Cert Denied, 181 L.Ed. 2d 410, 2011 U.S. LEXIS 7979. Other appellate cases which he has argued include, in the Supreme Court of California: Lockheed Martin Corporation v. Superior Court, 29 Cal.4th 1096 (2003) and HLC Properties v. Superior Court, 35 Cal.4th 54 (2005); in the United States Court of Appeals for the Ninth Circuit: Dow Chemical Co. v. Calderon, 422 F.3d 827 (9th Circ. 2005) and Abrego v. Dow, 443 F.3d 676 (9th Circ. 2006); in the United States Court of Appeals for the Federal Circuit: Optivus v. Ion Beam, 469 F.3d 978 (Fed.Circ. 2006); and in the California Court of Appeal: Karlsson v. Ford Motor Company, 140 Cal.App.4th 1202 (2006) and Coretronics Corp. v. O’Connor, 192 Cal.App.4th 1381 (2011).
