Paul Militello practices primarily in the area of Criminal Defense.
Mr. Militello has handled Criminal Cases in Central Florida for over 17 years. A native Floridian and lifelong resident of Central Florida, Mr. Militello attended the University of Florida where he received his B.A. in Criminology and Law in 1989 and then his Juris Doctor in 1992.
Mr. Militello served as an Assistant State Attorney prosecuting criminal cases in Citrus, Hernando, Sumter, Marion and Lake Counties from 1993 until 1997. During his years as a prosecutor, he prosecuted thousands of cases ranging from DUI's to Homicides. He handled almost half of all felony cases prosecuted in Citrus County from 1993 until 1996. In 1996, he was assigned as a Felony Drug Prosecutor in Marion County handling serious drug offenses until he left the prosecutors office in April 1997.
Since 1997, Mr. Militello has continued to practice in the area of Criminal law, defending people accused of criminal violations of all types. Some of the types of cases handled by Mr. Militello include Assault, Battery, Criminal Mischief, DUI, (Drunk Driving), Drug Offenses including Trafficking, Homicides, Sexual Battery, Theft, and Organized Fraud. He has handled numerous Jury Trials in criminal cases, including jury trials in Hernando, Citrus, Marion, Lake, Sumter, and Alachua Counties.
During that time, Mr. Militello has handled thousands of misdemeanor and felony criminal cases. His experience includes jury trials in all types of criminal matters. His experience also includes all types of legal defenses and pretrial motions, including motions to exclude and suppress evidence. Typical suppression issues in criminal cases include, unlawful search and seizure, lack of probable cause to stop or arrest a client, and statements or confessions from a client in violation of constitutional safeguards such as Miranda warnings.
Mr. Militello endeavors to provide the best possible defense to each of his clients. He is able to put his 17 years of experience both in and out of the courtroom to use when resolving his clients charges.
As a former prosecutor, Mr. Militello knowledge of the procedures and technique employed by prosecutors allows him to evaluate the strengths and weaknesses of the prosecutor's case as well as being able to evaluate the defendant's case.
As a former law enforcement academy instructor, he is familiar with the techniques, instruction and training provided to law enforcement officers, which provides additional insight when reviewing police officers conduct and reports in criminal cases.
Mr. Militello also handles sealing and expunging of criminal arrest records. Florida law allows you to seal or to expunge criminal records in certain cases. A successful sealing results in the criminal history record becoming confidential and exempt from public records requests (such as employment background checks) A successful expunction results in the physical destruction or obliteration of the criminal history records, subject to certain exceptions. Either a sealing or expunction will allow the person to lawfully deny or fail to acknowledge the arrests covered by the sealed or expunged records.
He is a member of the Florida Bar, Florida Association of Criminal Defense Lawyers, and Past President of the Citrus County Bar. He is a former law enforcement academy instructor.
