Alan Miller concentrates his practice in the areas of fiduciary counseling and institutional fiduciary services under ERISA. For more than 20 years he has regularly advised sponsors of pooled investment funds on fiduciary matters, such as ERISA plan assets compliance and prohibited transaction issues, with extensive experience in international investments.
Investment funds for which Alan is principal ERISA counsel include GreenOak Real Estate Funds, the Morgan Stanley Real Estate Funds, Westbrook Real Estate Funds, and Whitman/Peterson Partners.
Another significant area of Alan's fiduciary practice involves the specialized duties of fiduciaries in relation to employer stock investment funds in 401(k) plans, where he represents both plan sponsors and independent fiduciaries. He also has advised plan sponsors and independent fiduciaries regarding in-kind contributions of employer stock to defined benefit pension plans.
Alan has appeared many times as a speaker at national and local seminars and programs, including advanced pension programs sponsored by ALI/ABA and the ABA Joint Committee on Employee Benefits.
