Merrigan, Jessica E.

Ms. Merrigan focuses her practice in environmental law. Her experience includes representing clients in administrative negotiations with both the Environmental Protection Agency and state agencies, advising clients regarding their regulatory requirements and assisting in litigation of environmental claims, including contribution claims under the federal Superfund law.

Ms. Merrigan assists clients with federal environmental laws and regulations, including permitting and compliance requirements for the Clean Water Act, reporting requirements of the Comprehensive Environmental Response, Compensation and Liability Act (CERCLA or Superfund) and the Emergency Planning and Community Right to Know Act (EPCRA) and statutory and regulatory requirements of the Resource Conservation Recovery Act (RCRA). She also advises on clients on additional or equivalent state law requirements and assists with facility audits, compliance initiatives and waste reduction programs.

Ms. Merrigan has experience in the application and permitting process for solid waste facilities in Missouri, Kansas and Illinois. She has advised regarding the water protection requirements of Iowa, Nebraska, Missouri and Kansas, including federal, state and local requirements regarding storm water management for various localities in Missouri and Kansas.

Ms. Merrigan also works on environmental issues involved in property redevelopment and real estate transactions. Her work includes review of environmental assessments, evaluation of potential environmental liabilities associated with real estate transactions including those created by CERCLA, and evaluation of eligibility for federal and state Brownfields assistance programs. Ms. Merrigan assists clients in transferring and maintaining permits, through the completion of appropriate plans and applications and coordination with responsible agencies. Ms. Merrigan’s past experience has included national, regional and local projects ranging from single site sales to transactions involving hundreds of millions and up to $2 billion in assets.
