McNicholas, Matthew S.

Marty was born February 8, 1954 in Chicago, Illinois. He received his B.A. in 1975 from Northwestern University. He received his J.D. from the California Western School of Law in 1978.

Marty has extensive experience in representing creditors, fiduciaries, loan servicers and foreclosure trustees in complex bankruptcy, foreclosure and lender liability litigation, including class actions. He has served as a Director, and State Legislative Chairman, of the United Trustee's Association. He is a member of the Legal Issues Committee of the Mortgage Banker's Association of America, and is a member of the Loan Servicing Committee of the California Mortgage Bankers Association. Marty also served as a member of the Legal Resource Panel of the California Mortgage Association (formerly the California Trust Deed Brokers Association).

He is a member of the American Bankruptcy Institute, the REO Managers Association and of the San Diego Bankruptcy Forum. He acts as an expert witness on foreclosure and lending issues on cases throughout California.

Marty is a frequent lecturer on secured lending and creditor rights issues, and has authored many articles published in law and real estate periodicals including most recently, "Holding the Lines of Defense in Foreclosure Litigation," "Necessary Language for Use in the Notice of Default", "The Threat of Borrowers Using RESPA to Attack the Validity of Foreclosure Sales," and "Surplus Funds After Foreclosure and the Effect of a Declared Homestead" appearing in the United Trustee's Association Newsletter.
