Over 11 years experience as a practicing attorney, primarily representing public utilities, motor carriers, and other regulated entities before the Louisiana Public Service Commission and with regard to related matters.
REPRESENTATIVE PROJECTS:
- Successfully pursued and litigated numerous complaints before the Louisiana Public Service Commission (LPSC) on behalf of an electric utility against other electric utilities to enforce territorial restrictions and to prevent unfair promotional practice violations, resulting in the transfer of service to two residential subdivisions, two medical office buildings, an insurance building, a construction site and other residential and commercial customers.
- Successfully defended an electric utility in several complaints before the LPSC by other electric utilities regarding territorial restrictions and claims of violations of LPSC orders, achieving dismissal of three significant complaints by way of summary proceedings.
- In 2007, successfully defended appeal of an LPSC order on behalf of an electric utility, briefing and arguing the matter before the Louisiana Supreme Court in Washington-St. Tammany Electric Coop., Inc. v. Louisiana Public Service Commission, 959 So. 2d 450 (La. 6/29/07).
- In 2008, represented an electric utility in leasing a municipally-owned electric utility, pursuing referendum authority and governmental approval and drafting all documents and transactions related to the lease required for its approval.
- Advised an electric utility regarding issues related to the negotiation, drafting, and interpretation of numerous municipal franchise agreements.
- Represented the interests of electric utility, gas utility and motor carrier clients in numerous rulemaking proceedings before the LPSC related to a variety of issues, including renewable resource requirements, territorial restrictions, promotional practices, franchises with political subdivisions, disconnection of service, pole attachments, and the application and interpretation of laws and LPSC orders.
- Negotiated with existing LPSC-certified carriers to obtain authority for over 40 clients seeking LPSC authority to operate as common carriers of waste intrastate in Louisiana.
- Successfully represented three clients in separate contested proceedings before the LPSC to obtain authority to operate as common carriers of waste intrastate in Louisiana over the objections of existing LPSC-certified carriers, defending the order of the LPSC in one of these matters before the Louisiana Supreme Court in Vacuum Truck Carriers of Louisiana, Inc. v. Louisiana Public Service Commission, 12 So. 3d 932 (La. 5/5/09).
