Betsy R. Malik is a partner at Abrams, Fensterman, Fensterman, Eisman, Formato, Ferrara & Einiger, LLP.
Ms. Malik focuses her practice on representing a variety of health care providers on regulatory, compliance and transactional matters. Her clients include nursing homes, dialysis facilities, diagnostic and treatment centers, ambulatory surgical centers, pharmacies, home care agencies, adult care facilities, physician groups, management companies, and other ancillary providers.
Ms. Malik develops and implements corporate compliance and HIPAA compliance programs for health care providers and advises, counsels and represents providers with investigations on compliance issues. She advises health care providers in forming and organizing their businesses, negotiating operating agreements and employment contracts, structuring joint ventures and business arrangements to be in compliance with federal and state self-referral and fraud and abuse laws. In addition, Ms. Malik also represents physicians, pharmacies, and other health care providers on OIG, Medicare, DMERC and OMIG overpayment audits and exclusion proceedings.
Ms. Malik has substantial experience and skill representing nursing facilities at administrative and judicial proceedings at all levels involving challenges to various regulations and statutes.
She has been a presenter at industry associations, including New York State Health Facilities Association, New York State Bar Association's Health Law and Long Term Care Sections, the Hospital and Health Law Committee of the Nassau County Bar Association, American Association of Physicians of Indian Origin (AAPI), and Bergen Indian Medical Association (BIMA). She is a member of the New York State Bar Association's Health Law Section and the American Health Lawyers Association and is a charter member of the Rotary Club of Gold Coast/Lake Success and a Board Member of the Business Resource Group and the Executive Committee of BIMA.
Ms. Malik received her B.A. from the State University of New York at Binghamton and her J.D. from Hofstra University School of Law, where she was the Notes and Comments Editor of the Labor Law Journal. Ms. Malik is admitted to practice in New York, New Jersey, the United States Court of Appeals for the Second and Third Circuits, and the United States District Courts for the Eastern and Southern Districts of New York and the District of New Jersey.
