Emily Whelan is a partner in the firm's Intellectual Property Department, and a member of the Intellectual Property Litigation Practice Group. She joined the firm in 2000.
Practice
Ms. Whelan's practice includes patent prosecution, litigation and counseling in the fields of chemistry, biotechnology and pharmaceuticals. Her experience includes patent strategy across the spectrum from obtaining patent protection and portfolio management, to analysis of the competitive landscape and IP due diligence, to pre-litigation investigation and litigation, as well as reexamination.
Recent practice highlights include being part of teams involved in:
• Representing innovator pharmaceutical companies in ANDA patent infringement litigations involving pharmaceutical formulation and method of treatment patents;
• Obtaining partial summary judgment and successful settlement in medical device patent infringement litigation;
• Ex parte and inter partes reexamination of patents in chemical technology;
• Prosecuting patents and patent strategy for “green technologies,” including new battery materials and carbon monitoring;
• Managing a large patent portfolio including small molecules, pharmaceutical formulations and treatment methods for a major pharmaceutical company.
Professional Activities
Ms. Whelan is co-chair of the Patent Office Practice Committee of the Boston Patent Law Association. Ms. Whelan is also a member of the American Bar Association and the American Intellectual Property Law Association.
Honors and Awards
Ms. Whelan was named a "Massachusetts Super Lawyer's Rising Star" in the May 2006 and 2007 issues of Boston Magazine.
