Mr. Wells' practice focuses on business, real estate and health care litigation. His litigation experience includes jury, court-tried and appellate practice, as well as arbitration, mediation and administrative proceedings. He has served as manager of the firm's Banking Litigation section.
Mr. Wells' practice includes representation of lenders in the commercial finance and banking industries. He has served as lead counsel in a number of major commercial cases including suits against borrowers and guarantors and involving fraud claims. He has represented local and national companies in complex business litigation and has substantial experience in the following litigation practice areas: business and commercial litigation, foreclosures, commercial leases, creditors’ rights, contracts, business torts, non-compete, franchise and class action antitrust matters.
Mr. Wells has also represented hospitals, physician practice groups and individual physicians in a broad range of health care related litigation including representation of doctors and hospitals in Fair Hearing proceedings; appearances at EMTALA hearings; handling HIPAA issues; representation of pharmacies and individual pharmacists in proceedings before the Board of Pharmacy, and physicians before the Board of Healing Arts; and numerous other general business disputes involving health care entities.
- Mr. Wells successfully represented a major food distribution company in an action to enforce an option under a commercial lease in which over $4.5 million and the potential loss of a facility with over 200 jobs was at stake.
- Mr. Wells has represented national lenders and landlords in multi-million dollar actions for the foreclosure, eviction and transfer of operations and licensure of multiple assisted living facilities.
- Mr. Wells successfully defended a multi-million dollar bank fraud claim.
- Mr. Wells manages a collection docket of several thousand cases for a large local hospital.
- Mr. Wells has been regional litigation counsel for finance and leasing company and handled warranty and replevin cases in Kansas, Missouri and Nebraska.
