Most of Ms. Lo Presti's work focuses on complex litigation involving insurance coverage issues, with a focus in premise liability and maritime law, involving personal injury issues and/or complex torts and products liability issues.
On one case in particular, Ms. Lo Presti saved her client $3.5 million dollars when she discovered the Plaintiff had a history of mental illness and violence stemming from several prior incidents in Colorado. Ms. Lo Presti went the extra mile to subpoena out of state mental health and criminal records, which involved labor intensive court proceedings, and subpoenas from several Colorado courts. Ms. Lo Presti also discovered that the damages claimed by the Plaintiff were pre-existing in nature and contradictory to his medical treatment and records. The alleged brain injury claimed by the Plaintiff did not occur on the correct side of the brain to cause the neurological issues and emotional changes he was claiming as damages. Ms. Lo Presti prepared a Motion for Fraud on the Court and used the Motion as leverage at mediation to settle the case for substantially less money damages then sought by the Plaintiff. With uncompromising determination, Ms. Lo Presti spent months defending the large hotel client. The message sent was that any future lawsuits against that client would be met with stern resistance and would face a low likelihood of success of a lucrative settlement from this client. Ms. Lo Presti does not hesitate to aggressively defend cases on behalf of her clients, and uses her instincts and investigative experience to evaluate the case and uncover weaknesses and inconsistencies within a Plaintiffs' case. When not litigating, she fulfills that drive by also volunteering for organizations such as Habitat for Humanity, and volunteering at her church functions and fundraisers. In her spare time, Ms. Lo Presti also enjoys travelling and preparing meals for her family and friends.
Ms. Lo Presti received a Bachelor of Science degree in 1997 from St. John's University in New York, in Criminal Justice with a minor in Psychology. She received a Juris Doctor Degree in 2003 from Nova Southeastern University Shepard Broad Law Center and her Master of Law Degree (L.LM.) in Litigation and Alternative Dispute Resolution from The George Washington University School of Law in 2005. She is a Member of the American Bar Association, Florida Bar Association, and the Dade County Young Lawyers Bar Association. Ms. Lo Presti is admitted to practice law in the Northern, Middle and South Districts of Florida, the 11th Circuit Court of Appeals, and the United States Supreme Court.
