Samuel G. Livingston, P.C. has obtained multiple record bad faith jury verdicts in the State of Colorado starting in 2000.
In Roach v. American Family Insurance Company a Denver District Court jury awarded $2 million against American Family Insurance for denying an $800 property claim under circumstances where American Family altered underwriting records and undertook its denial knowing that its actions were contrary to Insurance Commission regulations after hiding a memorandum showing knowledge of those circumstances throughout most of the case. In 2007, Samuel G. Livingston, P.C. obtained a second record Colorado verdict, again involving bad faith by American Family Insurance, in the matter of Peressini v. American Family Mutual Insurance Co wherein the insurer denied a claim of approximately $125,000 resulting in a $3 million verdict. The evidence involved a Colorado State Business Plan wherein company employees were instructed to reduce claims payouts to stay in line with other insurance companies, and ignore the needs of the insureds. The case was highly publicized by Channel 7 News, and nationally, surrounding evidence that American Family employees only paid claims "when pigs fly." Samuel G. Livingston, P.C. has obtained numerous multimillion dollar settlements, both confidential and of public record, including a $2 million settlement in the matter of (Meat Market) v. American Family, a $2 million settlement in the matter of (A Carbondale Family) v. American Family, and a $3.75 million settlement in the matter of Kay Watts v. State Farm.
Mr. Livingston has presented multiple lectures on behalf of the Colorado Trial Lawyers Association and the National Business Institute surrounding bad faith and particularly discovery in bad faith matters. Mr. Livingston has testified on multiple occasions before the Colorado Legislature surrounding insurance matters and has worked extensively with the Colorado Division of Insurance to promulgate regulatory reform to curb insurance abuses. Samuel G. Livingston, P.C. has successfully handled all types of insurance cases including coverage determinations, auto and homeowners claims, HOA claims and title insurance claims in both first and third-party litigation, and has obtained certification of a 17,500-member class action against American Family Insurance Company regarding coverage issues.
Attorney Samuel G. Livingston graduated from Heritage High School in Littleton, Colorado in 1978, the University of Northern Colorado in 1982, and Drake University Law School in 1985 where he received the American Jurisprudence Award in Evidence. His initial experience involved working in private practice for insurance companies defending bad faith insurance and personal injury claims and ultimately started his own practice in 1990. Starting in 1996, Mr. Livingston has worked exclusively for consumers against insurance carriers presenting cases involving bad faith breach of insurance contract and personal injury claims.
