Mr. Warthen’s practice includes real estate, construction, and commercial litigation as well as real estate transactions. He is an experienced trial attorney familiar with all aspects of civil dispute resolution in the state and federal courts and in arbitration. Mr. Warthen is licensed to practice before all courts in Colorado and Illinois, the United States Courts of Appeals for the 7^th and 10^th Circuits, and the United States Supreme Court. He received his Juris Doctor from the University of Illinois College of Law in 1992, and his Bachelor of Arts from the University of Illinois at Urbana-Champaign in 1989.

Mr. Warthen's real estate and construction litigation practice includes construction defects, mechanics’ liens, title claims, landlord-tenant matters, and contract disputes.  He has successfully represented developers, home builders, homeowners, subcontractors, material suppliers, title companies, and lenders.  His real estate transactional practice includes handling of all aspects of the purchases and sales of commercial and residential real estate, formation of business entities, advice and  documentation for complex commercial leasing relationships, and legal services relating to the residential mortgage industry. In 2010, Mr. Warthen was presented with the Barbara S. Jacob Award by the Colorado Mortgage Lenders Association for his outstanding work as a volunteer and General Counsel to that organization.  He is an active member of NAIOP, the association for commercial real estate developers, and is currently on its Membership Committee.

Prior to his current position, Mr. Warthen worked in-house for Koch Industries, Inc., handling oil & gas litigation against private parties and the United States Department of Justice, including successfully resolving one of the largest Clean Water Act cases ever filed, as well as for a Denver-based real estate investment trust, handling litigation and transactional matters across multiple jurisdictions.  His in-house experience has provided him with a practical, bottom-line focus that he brings to his practice for the benefit of his clients.  Mr. Warthen has been in private practice in Denver since 2002.
