Ling, Stephen D.

Mr. Waters represents clients in litigation matters in both state and federal courts, as well as arbitrations using AAA, ICDR, and Texas General Arbitration Act rules.  His past engagements have involved disputes arising from commercial construction, pre-paid calling card distribution, mortgage lending, engineering & procurement, manufacturer/distributor contracts, NAESB contracts, and a variety of other business-to-business matters.  Mr. Waters has handled cases for both plaintiffs and defendants.  Before joining Campbell Harrison & Dagley, Mr. Waters was a litigation and arbitration associate in the Houston office of Mayer Brown LLP, and a founding partner of Rapfogel Waters PLLC. 

Mr. Waters graduated with honors from the University of Texas School of Law in 2006, and with a bachelor of science in economics with departmental honors from Clemson University in 2002.   He is admitted to practice before all state courts within the State of Texas and also before the United States District Court of the Southern District of Texas and the United States Bankruptcy Court for the Southern District of Texas.  Mr. Waters is also a member of the Houston Bar Association and its litigation, construction law and probate, trusts, and estate law sections.

Representative Cases and Results

Represented a plaintiff property owner in a multimillion dollar construction dispute involving claims of negligent design, engineering, and construction work on a commercial property in Texas.  Case settled for a confidential sum.

Acted as first chair plaintiff's counsel to a telecommunications company against a former distributor involving claims of breach of contract and misappropriation of telecommunication services.  Obtained summary judgment for the client despite counterclaims involving allegations of trademark and copyright violations.

Acted as first chair claimant's counsel in a successful AAA arbitration of a breach of contract claim related to pre-paid calling cards.  Respondent alleged it was not bound to arbitrate as a non-signatory to the agreement leading to a successful motion to compel arbitration in New Jersey federal court.

Acted as third-party defendants' counsel in an action brought by their title insurer, and recovered 100% of the claim value plus attorneys' fees from the title insurer after pursuing the title insurer for failing to accept coverage.

Represented an engineering and procurement contractor in defending claims in excess of $200,000,000 and prosecuting counterclaims for nonpayment in Texas state court.  Case settled for a confidential sum.

Acted as first chair claimant's counsel in two successful ad hoc arbitrations on behalf of a Texas construction firm to remove liens on commercial properties.
