Josh has won major verdicts in courtrooms throughout Connecticut on behalf of clients who have been permanently harmed or killed because of medical malpractice. Many of these victories were in cases where the insurance companies offered little or no money, believing that they would win. In one such case, Josh represented the widow of a 49-year-old man who died of a mismanaged heart condition. The jury verdict of 22.5 million dollars in that case is the largest wrongful death verdict in Connecticut.
In 2010, Josh won a verdict of 2.45 million dollars on behalf of a 62-year-old woman who died from cancer that was wrongly diagnosed as ovarian cancer when, in fact, she had a form of appendix cancer.
Josh's numerous other courtroom victories include a verdict of almost $2.5 million on behalf of a young girl who suffered a serious birth trauma injury to the nerves of her shoulder (known as the "brachial plexus") after her shoulders became stuck during delivery (a condition known as shoulder dystocia). Until recently, this was the highest verdict for a birth related brachial plexus injury in Connecticut, only to be eclipsed by his law partner Kathleen Nastri, who obtained a slightly higher verdict in this type of case.
His earlier victories include winning a verdict for a nurse anesthetist whose stroke was misdiagnosed, winning an $800,000 verdict from a Litchfield jury. In all of the cases cited above, the insurance company did not offer any money at the time of trial, forcing litigation. In 2003, Josh won an $810,000 award from a Stamford jury on behalf of an 89-year-old woman whose doctor botched a surgery to repair a leg fracture causing even further fractures. The insurance company had refused to settle the case years earlier for $500,000, and never offered a red cent until the time of trial, at which point it offered less than the medical bills.
While Josh has won meaningful personal injury verdicts for his clients in court, he has also handled more than thirty other complex medical malpractice cases that have resulted in settlements in excess of $1 million.
These settlements have helped his clients to have better and more satisfying lives. Josh has also participated in other cases that do not involve bad medical care. For example, he represented a victim in a well-publicized med-evacuation crash and obtained a multi-million dollar settlement on behalf of his client, who was herself a health care professional. Josh has also provided free representation under Trial Lawyers Care to a family who lost a father/husband in the World Trade Center on 9/11.
He is the recipient of the Connecticut Law Tribune's "new leader of the law" award, editor of the CT Personal Injury Forms book, and sits on the Board of Connecticut Legal Services, an organization dedicated to helping Connecticut's poorer citizens gain legal representation in civil cases. He is a frequent lecturer on matters related to trial practice, both locally and nationally.
