Barbara Kirschten is a special counsel in the Tax Practice Group. She joined the firm in 2002. Ms. Kirschten’s practice focuses on the tax and non-tax aspects of nonprofit organizations. 

Practice

Ms. Kirschten has extensive experience incorporating and obtaining recognition of tax-exempt status for nonprofit organizations and creating affiliates in foreign countries; advising nonprofit organizations with respect to mergers and reorganizations, unrelated business income tax issues, incentive compensation arrangements, private foundation rule issues, charitable solicitation rules and the obligations of directors and officers; and handling IRS controversy work involving the potential revocation of tax-exempt status.

Professional Activities

Ms. Kirschten is a member of the American Bar Association, Section of Taxation, Exempt Organizations Committee, Subcommittee on Museums and Other Cultural Organizations (Co-Chair); the DC Bar Association, Taxation Section, Exempt Organizations Committee (former Chair); and the DC Bar Association, Taxation Section (former Member of the Steering Committee). Ms. Kirschten is a frequent speaker on issues affecting tax-exempt organizations and she has an extensive publications list. She is the author of The Nonprofit Corporation Forms Handbook and co-author of a leading treatise on federal and state taxation of exempt organizations, and the BNA Tax Management Portfolio, Charitable Contributions:  Income Tax Aspects. She has also published numerous articles covering a broad range of issues affecting tax-exempt organizations.
