Todd Swatsler has handled complex commercial litigation throughout the United States for 28 years. He has particular experience in bankruptcy and restructuring litigation, energy matters, the health care industry, and federal and state tax disputes.
Todd played a key role in the Firm's restructuring efforts on behalf of Chrysler and its representation of the Financial Guaranty Insurance Company in connection with a large reinsurance transaction. He recently represented AEP in a breach of contract case in federal court in New York. After a trial and appeal, the case settled with AEP receiving $263 million. Other energy clients have included Cinergy, Columbia Gas, Dayton Power & Light, Duquesne Light Company, and FirstEnergy.
Todd has tried tax disputes around the country. For the Ohio Farm Bureau, he tried a landmark case on the taxability of payments made to a nonprofit corporation in exchange for agreements not to compete. He has represented Dell in tax nexus litigation nationally and successfully tried the lead case in Ohio on the use of unitary appraisals to value interstate property. Other tax clients include Ameritech, Campbell Soup Company, Colgate-Palmolive, Macy's, Sprint, and Verizon.
With respect to health care, Todd has represented Bon Secours Health System, the Guthrie Clinic, Hillenbrand Industries, ProMedica Health System, and SSM Health Care in a variety of disputes.
Todd coauthored the Lawyer's Cooperative Sixth Circuit Federal Practice Guide. He has been named an Ohio "Super Lawyer" (for business litigation and tax) and speaks frequently on matters of trial practice and e-discovery.
