Kelly, C. Michael

Bert Sturtevant's practice is concentrated in the area of utilities regulation. He has experience in more than 15 water and energy rate proceedings; electric, gas and water, and transmission line facility siting approvals; merger and acquisition approvals; regulatory investigations; and other matters before state utility commissions. His experience includes the representation of water and energy utility companies in connection with merger and divestiture transactions, regulatory counseling and litigation, acquisition and disposal of utility properties, obtaining certificates of authority to construct and operate utility facilities, and agreements for service to water, wastewater, and electric and gas wholesale and industrial customers. He also has experience with related appellate court proceedings, including judicial review of regulatory agency decisions.

In addition, he has experience in counseling companies on complex environmental compliance issues in the air pollution, emergency planning, toxic substances, and solid and hazardous waste management areas. He has experience working with the Clean Air Act, CERCLA, RCRA, the Emergency Planning and Community Right-to-Know Act, the Occupational Safety and Health Act, and the Toxic Substances Control Act, as well as various state and international environmental laws.

Prior to attending law school, Bert spent several years in the environmental services field in China, working for the U.S. and Foreign Commercial Service in Beijing and serving as a consultant for the British firm of Atkins China in Hong Kong. Bert speaks conversational Mandarin Chinese.
