Mr. Kalas practices in the Firm's Complex Litigation, Pharmaceutical Products, and Toxic Torts & Products Liability groups. He is part of the defense team representing Novartis Pharmaceuticals Corporation in the ongoing bisphosphonate litigation centralized before the United States District Court for the Middle District of Tennessee, where he has focused on defending against the plaintiffs' core liability theories, such as concealing clinical trial information and failing to warn about adverse effects. Mr. Kalas has contributed significantly to motions practice in this litigation, having researched and drafted case-specific dispositive motions as well as motions directed to litigation-wide evidentiary issues. He also has significant trial experience after working with a number of trial teams to compile exhibit lists, prepare affirmative and responsive deposition designations for corporate witnesses, and provide other trial support as needed.
In addition to his pharmaceutical products liability experience, Mr. Kalas has defended wrongful death claims brought against corporate employers following workplace fatalities; he has litigated personal injury and property damage claims following alleged exposure to perchlorate and other volatile organic compounds ("VOCs") from groundwater contamination; and he has represented employers seeking to enforce choice-of-law and arbitration agreements contained within employees' employment contracts.
