Terry is a shareholder in the firm of Briggs and Morgan, Professional Association. He is based in our St. Paul office and serves as co-chair of the Nonprofit Practice Group and head of the firm's Estate Planning and Administration Section. He practices principally in the areas of:
Terry works extensively with tax-exempt charitable entities, most of which are organized for educational, religious and grant-making purposes. A significant number of Terry’s private family clients operate private foundations or other charities to advance their charitable interests. Terry forms charitable organizations, and obtains IRS recognition of their status as tax-exempt entities, both in individual cases and in a “group ruling” basis. He advises a number of private foundations on matters such as governance; grant-making practices; and federal tax compliance, including the various private foundation excise tax rules. Terry has represented a number of charitable endowment funds in cy pres cases, to obtain changes in the terms of the trusts in light of changed circumstances. He also assists with grant agreements for donors who wish to create incentive or other special purpose grants. For some charities, he coordinates Briggs’ representation of the client by multiple attorneys of the firm.
Terry also serves on a number of nonprofit boards. He is a trustee and vice chair of Houghton College in New York, a director of the Briggs and Morgan Foundation, and secretary of the Elmer L. and Eleanor J. Andersen Foundation and the Donald D. and Angela W. Wozniak Foundation. He is a past board member and treasurer of the St. Anthony/New Brighton Education Foundation. Terry has been listed in Minnesota Super Lawyers, which represents the top six percent of Minnesota lawyers, as well as The Best Lawyers in America .
Born in Cedar Falls, Iowa, Terry received his B.A. summa cum laude from Houghton College. He received his law degree from Harvard University Law School, where he was editor-in-chief of the Harvard Journal of Law and Public Policy. Following law school, he clerked for Justice C. Donald Peterson of the Minnesota Supreme Court. Terry joined Briggs and Morgan in 1983. He is admitted to practice in all Minnesota state and federal courts, the Eighth Circuit Court of Appeals, the United States Tax Court, and the United States Supreme Court.
