Aviva Warter Sisitsky advises clients on litigation concerning securities, derivatives, and other financial products, including credit default swaps and collateralized debt obligations.
As a member of the Firm's Financial Institutions Litigation & Regulation Practice, Aviva routinely provides prelitigation advice on documentation and risk mitigation concerning derivatives litigation. She works closely with clients to review their transaction documentation and to create strategies to monetize the derivatives and mitigate litigation risks. Aviva is the Administrative Partner for the global Financial Institutions Litigation & Regulation Practice.
Aviva has extensive experience in the application of bankruptcy law to derivatives, including the application of the bankruptcy code safe harbors. She is currently derivatives counsel for the debtors in the largest bankruptcy in U.S. history, entitled In re Lehman Brothers Holdings Inc., et al., Case No. 08-13555 (JMP) (Jointly Administered).
Aviva also has substantial experience in litigating complex securities fraud and commercial cases, such as ERISA stock drop cases and representing clients through trial in adversary proceedings in bankruptcy court.
Aviva is a member of the New York and New Jersey state and federal bars.
