Morgan Hirst has represented clients in a wide range of matters, having been a member of trial teams in both state and federal courts, along with arguing appeals before federal appellate and state supreme courts.
Most recently, Morgan second-chaired an eight-week jury trial described by the local press as "dramatic as anything ever seen in an Edwardsville courtroom" in representing a large Midwest law firm in a legal malpractice case that took place in Illinois state court in Madison County. Morgan also served as part of a trial team in the successful defense of a $146 million (pre-trebling) antitrust claim against a large client in the automotive industry in Iowa federal court.
Morgan has focused much of his practice on civil and criminal matters concerning clients in the pharmaceutical industry. In 2007, he successfully argued and obtained reversal before the Missouri Supreme Court of that state's Board of Pharmacy's imposition of discipline against a Firm client. Additionally, Morgan successfully obtained dismissals of complaints against pharmaceutical clients in a federal False Claims Act case seeking hundreds of millions of dollars related to drug pricing in the Eastern District of Louisiana and in a breach of contract and fraud action brought by a physician related to drug pricing in the Northern District of Illinois. Morgan also has helped coordinate teams in representing clients in industrywide investigations of the pharmaceutical industry conducted by federal, state, and congressional authorities.
In addition, Morgan has experience representing clients in federal and state tax disputes, civil rights class actions, and complex commercial disputes. Morgan also has devoted time to the Firm's pro bono efforts, including appeals of adverse immigration rulings before the Fifth and Seventh Circuits.
