Phil is a shareholder with Briggs and Morgan, Professional Association. He is based in our Minneapolis office and is a member of the Business Litigation Section and the firm’s Telecommunications Practice Group. Phil practices principally in the areas of:
As a member of the Telecommunications Practice Group, Phil has represented clients before the FCC, more than 20 state public utilities commissions, and in state and federal courts.
In universal service matters, Phil has represented clients seeking to be designated as eligible to receive universal service funding, assisted clients in developing regulatory compliance programs and initiatives related to involvement in universal service programs, drafted comments for federal and state rulemaking proceedings, and worked with clients involved in corporate transactions with other designated entities.
Phil has represented carriers in interconnection negotiations in more than 30 states, as well as multiple interconnection arbitrations conducted in accordance with the 1996 Telecommunications Act. Phil has also drafted and filed comments in federal and state rulemaking proceedings, addressing interconnection and compensation obligations.
In regulatory matters, Phil has worked with clients to develop and file comments in state proceedings addressing regulatory requirements applicable to wireless carriers. He has also worked with clients to draft and negotiate IRU and fiber sale contracts, and to resolve disputes arising under such agreements.
Phil has participated in a variety of telecommunications industry seminars and panels, presenting for the CQA Mobile CETC Workshop, “New FCC Requirements for CETC Applicants and Existing CETCs” in 2006. He was also a panelist for the National Association of Regulatory Utilities Commissioners’ “Wireless Substitution of Wireline: Policy Implications.” In 2000, he participated in the Minnesota CLE Communications Law Forum, presenting “Jurisdictional Conflicts in the Implementation of the Local Competition Provisions of the Telco Act of 1996.”
Phil has handled a wide variety of general litigation matters and has tried cases in Minnesota state courts, the Minnesota tax court, and federal courts in Minnesota and South Dakota. He is also admitted to practice before the U.S. Court of Appeals for the 8th, 9th and 10th Circuits, and the U.S. district courts in Minnesota and Colorado.
In the transportation law area, Phil has drafted contracts and handled litigation for both shippers and carriers, and has assisted carriers in regulatory compliance matters at both the state and federal level.
Phil's bankruptcy practice has been focused on litigation in bankruptcy court. He has represented clients in prosecuting and defending adversary proceedings, including cases involving the discharge of debts and the assertion of preference claims. Phil has also litigated motions related to the application of the automatic stay and other procedural and substantive matters.
Phil has been named a "Rising Star" by Minnesota Law & Politics. He serves as pro bono legal counsel for the St. Paul Festival and Heritage Foundation, which presents the St. Paul Winter Carnival.
Born in Lafayette, Indiana, Phil received his B.A. cum laude from Trinity University and was elected to Phi Beta Kappa. He received his law degree cum laude from the University of Minnesota Law School, where he was an editor of the Minnesota Law Review. Phil received a master's degree in political science from the University of Illinois, as well as a master’s degree in public affairs from the University of Minnesota’s Humphrey Institute. He joined Briggs in 1995.
