W. Evan Price II has been a successful trial attorney in Columbus, Ohio for over twenty years. During that time, he has gained extensive experience trying a variety of cases in the courtroom and in arbitration proceedings.
Evan's career began at Vorys, Sater, Seymour and Pease in 1991. While there, Evan served as a special prosecutor in one of Ohio's largest securities fraud cases and played a major role in a five-month jury trial. Evan also gained extensive experience representing both plaintiffs and defendants in business and commercial litigation including class actions involving alleged environmental contamination arising from the operation of nuclear facilities.
In 2000, Evan joined the business litigation department of Arter & Hadden's Columbus office. After Arter & Hadden dissolved in 2003, Evan joined with other attorneys in that office to found Bailey Cavalieri, LLC and became a member of the firm in January, 2005.
While a member at Bailey Cavalieri, Evan served as lead counsel for Mount Carmel Health Systems in an arbitration that resulted in an award requiring United Healthcare of Ohio to pay Mount Carmel over $34,000,000. Evan served as co-lead counsel in a federal bench trial that resulted in a defense judgment on a $17,000,000 claim arising from the acquisition of a company in Cincinnati, Ohio. In addition, Evan obtained an arbitration award exceeding $700,000 for Ward Engineering arising from the breach of a contract for the development of a medical device.
Evan served as lead appellate counsel in overturning a $750,000 jury verdict arising from a shareholder dispute over the dissolution of a temporary staffing agency in Tiffin, Ohio. While at Bailey Cavalieri, Evan served as lead trial counsel on many cases for Time Warner Cable. In one notable Time Warner case, Evan won a defense verdict in a wrongful death case following a two week jury trial.
Evan continued his career as a trial attorney after he joined James E. Arnold & Associates in August of 2010. Since joining the Firm, Evan shared lead counsel role with Scott J. Stitt in a bad faith insurance case resulting from major storm damage to apartment complexes. This case resulted in a highly favorable six-figure settlement immediately after Scott’s opening statement.
Evan and Scott were lead counsel in another case where James E. Arnold & Associates represented the manager of a multi-million dollar egg farm operation on a claim for bonus compensation arising from a breach of the manager’s Consulting and Management Agreement. Defendants denied liability, asserted a counterclaim exceeding $4,000,000 and refused to even make a settlement offer. The counterclaim was later dismissed and, following a three-day arbitration hearing, the manager received an award for the exact amount claimed — $1,333,949.
Evan continues to represent companies and individuals in a wide-range of cases involving business and commercial disputes as well as tort litigation.
