Mr. FitzGerald's practice focuses on intellectual property law. His litigation experience includes civil actions for patent, copyright, trademark, and trade dress infringement as well as actions involving licensing disputes, trademark dilution, unfair competition, and false advertising. Mr. FitzGerald also advises clients regarding both domestic and international registration, enforcement and licensing of trademarks and copyrights and drafts licensing agreements for various forms of intellectual and industrial properties.
Mr. FitzGerald represents clients in all matters and proceedings before the Trademark Trial and Appeal Board and advises clients on matters within the Copyright Office and before the Registrar of Copyrights including formalities of applications, public domain clearances, and responses to refusals from the Copyright Office. He has also negotiated and drafted co-authorship, work-for-hire, and producer/artist agreements in the music industry.
Mr. FitzGerald has worked with agents, representatives and officers of Customs and Border Protection on behalf of consumer product designers and manufacturers to prevent the importation into the U.S. of merchandise bearing counterfeit trademarks. Mr. FitzGerald also represents clients in Uniform Domain-Name Dispute-Resolution Proceedings (UDRP) and protects and enforces clients’ rights on the Internet, including violations arising from search engine (sponsored link) advertisements and unauthorized linking to clients’ websites.
