Russ Eggert is a partner in the environmental department at Lathrop & Gage. With nearly 40 years of experience, Russ has a practice that encompasses the full range of environmental law, including: litigation, regulatory compliance counseling, due diligence, and work on transactions across the United States, Central and South America, the EU, and China.
Russ devotes the largest portion of his practice to litigation and litigation avoidance. In recent years, he has defended (including trials and appeals) federal and state enforcement actions across the country under the Clean Air Act, Clean Water Act, RCRA, and CERCLA; multiple private cost recovery actions under CERCLA and various state laws; environmental tort claims, including class actions; and citizen suits under the Clean Air Act, Clean Water Act, and RCRA. He has also represented industry in challenges to the EPA’s jurisdiction under the Commerce Clause; the EPA’s administration of the Clean Air Act and Clean Water Act; and constitutional challenges to state product “take-back” legislation.
Russ has served as national environmental counsel to a leading manufacturer and in that role provided compliance advice on a wide range of regulatory issues across multiple jurisdictions.
