Michael J. Dudek is an associate attorney who concentrates his practice on surety law, commercial bankruptcy, and commercial litigation. He handles a wide array of litigation matters with experience handling complex matters in both state and federal courts.
Michael’s experience includes representing sureties in complex commercial bankruptcy cases. He has negotiated agreements with project owners and debtors-in-possession/trustees to ensure payment of subcontractors and other potential bond claimants out of retained contract funds. He obtained relief from the automatic stay in a contractor’s bankruptcy case to obtain retained contract funds where the motion was contested by one of the debtor’s secured lenders over priority rights in the funds. In the bankruptcy of a large real estate developer, he successfully intervened on behalf of a surety in a debtor’s adversary proceeding seeking equitable subordination of claims over the objections of the secured lenders and the creditors’ committee. In addition to representing sureties in bankruptcy cases, Michael routinely represents sureties in commercial litigation and probate matters.
