Justin E. Proper is counsel in the Commercial Litigation Department. For the last 10 years, he has represented automotive manufacturers in product defect cases, including breach of warranty, lemon law and property damage cases. Mr. Proper also has experience representing clients in a wide array of commercial litigation matters ranging from actions involving breach of contractual duties to restrictive covenants, fraudulent misrepresentation, conversion and breach of trust, among other matters.
Mr. Proper has been at the forefront of developing case law in product defect and lemon law cases in New York, Connecticut and Massachusetts. As a result of his proactive litigation philosophy, he has been able to obtain decisions for his clients that have resulted in the dismissal of dozens of cases on summary judgment. These decisions have served to benefit not only his clients, but the entire automotive industry.
Mr. Proper also has extensive arbitration, trial, and appellate experience. He has tried 20 cases before judges and juries in three different states, obtaining complete defense verdicts in 18 of those cases. Mr. Proper has successfully arbitrated hundreds of cases before arbitrators and tribunals in five states and has argued hundreds of motions and appeals before trial and appellate courts in the states where he's admitted to practice, including the Supreme Court of Connecticut.
Mr. Proper received his B.A. from Siena College in 1996 and his J.D., magna cum laude, from Albany Law School in 1999. Mr. Proper is licensed to practice in Pennsylvania, New York, Massachusetts, Connecticut, West Virginia and Georgia.
