Ms. Davila served as extern for The Honorable Lisa Hill Fenning, U.S. Bankruptcy Court, and as an instructor of Business Law for the University of Phoenix, Southern California campus.
Although she has experience in several areas of practice, including insurance defense, business law and construction defect litigation, at AMC, Ms. Davila's current focus is in the areas of employment litigation including, but not limited to, the defense of claims brought under California's Fair Employment and Housing Act (e.g. harassment, discrimination, retaliation, failure to prevent, failure to accommodate, failure to engage in the interactive process, negligent training and supervision, wrongful termination, constructive discharge, violence in the workplace, violations of the Family Medical Leave Act, and violations of the Ralph Civil Rights Act), and Title VII of the Civil Rights Act.
In addition, Ms. Davila has extensive experience in defending and resolving wage and hour claims alleging violations of California's Labor Code, California's Business & Professions Code 17200, et seq., Private Attorney's General Act, and Fair Labor Standards Act including, but not limited to unpaid minimum and overtime wages, meal break and rest period violations, misclassification claims, unpaid vacation pay, unpaid split-shift premiums, wage statement and final payment obligation violations.
Moreover, Ms. Davila has had significant success in defending against administrative complaints filed with the Department of Fair Employment and Housing and has successfully resolved claims for violations of Labor Code 132a, as well as "serious and willful misconduct" benefits under Labor Code 6400-6404 before the Workers' Compensation Appeals Board. Notably, Ms. Davila has successfully and efficiently resolved employment law claims while the claims are still in a pre-litigation stage, or shortly thereafter, through the effective use of alternative dispute resolution.
In addition to her employment litigation practice, Ms. Davila has extensive experience in defending and litigating claims on behalf of financial institutions and credit unions including, but not limited to, Lemon Law claims (violations of the Song-Beverly Consumer Warranty Act), violations of the Automobile Sales Finance Act (Rees-Levering), violations of the Unruh Act and violations of the Consumer Legal Remedies Act.
Ms. Davila is also a licensed real estate broker with California's Department of Real Estate. Ms. Davila's experience in real estate transactions includes successfully defending and litigating in State and Federal Courts claims asserting, among other things, violations of the Truth-in-Lending Act, unfair business practices, wrongful foreclosure and predatory lending.
