Bob Cultice is a partner and a vice chair of the firm's Litigation/Controversy Department, and the co-chair of the Business Trial Group. He joined the firm in 2000. Mr. Cultice maintains an active trial practice in complex commercial litigation having tried a substantial number of cases and arbitrations in numerous jurisdictions throughout the United States. He has nearly 60 reported decisions to his credit.
Practice
Mr. Cultice has litigated and arbitrated in various industries covering a wide range of complex commercial matters, including multiple jury and bench trials, and arbitrations, in finance and banking, securities, automotive, petroleum marketing, intellectual property and numerous other commercial subjects. He also serves as national counsel for distribution, marketing, trade and franchise disputes for a major automotive manufacturer. Recent examples of his extensive trial and arbitration experience include:
- Lead trial counsel representing a plaintiff in a seven week federal court jury trial resulting in a favorable verdict and award of $104 million in damages under the False Claims Act. The case involved false claims submitted to the US Government by a group of international and domestic construction companies that had rigged bids in connection with infrastructure projects in Egypt born of the Camp David Peace Accords. The award was among the three largest damage assessments ever made under the False Claims Act and among the largest damage awards of any case tried in 2007.
- Lead trial counsel for the defendant in a lengthy federal court jury trial in a case involving fraud claims and violations of state and federal franchise and trade statutes.
- Lead trial counsel for the defendant in a lengthy federal court bench trial in a case involving trade dress infringement and theft of trade secrets relating to the famous Dodge Viper sports car.
- Lead trial counsel for the defendant in a lengthy Delaware state court jury trial in a case involving claims arising from the termination of a Lamborghini distributor for the U.K.
- Lead trial counsel in multiple arbitrations and related federal court case involving claims of fraud and unfair trade practices in the pricing of parts.
- Appearances in various state and federal appellate courts, including the United States Court of Appeals for the First, Third, Fourth, Fifth, Ninth and Eleventh Circuits and appellate courts of Delaware, Illinois, Vermont, Maryland, Massachusetts and New Mexico.
