Jonathan N. Osder is a partner in Donahue Gallagher Woods LLP, where he specializes in intellectual property law. Mr. Osder’s practice extends internationally and he is often engaged in cutting edge legal issues that involve copyrights, high technology (including computer, Internet, and new media law), trademarks, domain name disputes, unfair competition, rights of publicity, and general corporate and civil matters.
Mr. Osder counsels diverse clients, including prominent software companies, universities, musicians, computer programmers, authors, Internet and application service providers, artists, animators, professors, producers, professional athletes, restaurateurs, photographers, and other entrepreneurs on how to secure, protect, license, transfer, and enforce their proprietary rights.
He has substantial experience as a professional negotiator and has demonstrated his expertise through his handling of many multi-million dollar negotiations for which he also drafted complex agreements. Indeed, Mr. Osder is an experienced and talented negotiator and drafter of various agreement types, including license, intellectual property transfer, advertising, book publishing, software development, consultation, distribution, settlement, non-disclosure, Internet, and computer-related agreements.
As part of our firm’s entertainment law practice, Mr. Osder creates and negotiates agreements unique to the entertainment industry, such as distribution, merchandise, synchronization, public performance, music publishing, musician tour, character licensing, recording, sponsorship, and right of publicity agreements. He provides such legal services to clients such as Carlos Santana, Journey, Phish, Ice Nine Publishing, and Formula One racing world champion Jenson Button.
Mr. Osder also negotiates for clients clearances from rights holders, including record labels, performance rights societies, motion picture studios, the Screen Actors Guild, the Directors Guild, and the Writers Guild. In connection with the anniversary of the Eiffel Tower, Mr. Osder recently helped The Société d’Exploitation de la Tour Eiffel (SETE, which operates the Eiffel Tower) clear such rights to many Hollywood blockbuster films so scenes featuring the Eiffel Tower could be publicly displayed there.
Mr. Osder helps supervise the firm’s anti-piracy efforts conducted on behalf of Autodesk, BSA, and the Software & Information Industry Association. Mr. Osder has negotiated the successful recovery of several million dollars prosecuting civil claims of software copyright infringement on behalf of clients such as Autodesk, Intuit, and the Business Software Alliance (BSA), whose members include Adobe Systems, Apple Computer Filemaker, Autodesk, Bentley Systems, Lotus Development, Microsoft Corporation, Network Associates, Novell, and Symantec.
Mr. Osder earned his Bachelor of Arts degree in English from the University of California, at Berkeley (B.A., 1989) and was awarded his law degree from the University of San Francisco (J.D., 1993), where he served as Comments Editor of the University of San Francisco Law Review. While awaiting his California Bar results, Mr. Osder worked in Melbourne, Australia for Phillips Fox Solicitors, one of Australia’s largest law firms. Mr. Osder then associated with Donahue Gallagher Woods LLP in 1994. He is a member of the State Bar of California (Intellectual Property Section) and the Alameda County Bar Association. Mr. Osder has served as the firm’s Chief Operations Officer since 2005.
