Bob Case works with business owners and the representatives of corporations to successfully resolve the various contract and litigation issues commonly faced by businesses. His litigation practice focuses on commercial and residential real estate issues, commercial contract disputes, construction-related problems, and banking and creditor rights issues. Mr. Case's transactional practice includes assisting the firm's construction and banking clients with contract preparation and review, as well as with the closing of land sale and purchase agreements. Mr. Case has successfully combined his litigation experience with his contract and real estate practice to successfully resolve common as well as complex problems faced by his clients. Mr. Case is rated "AV," the highest rating achievable for legal ability and ethics by the Martindale-Hubbell Law Directory, which is the facilitator of the peer review process that rates attorneys. Mr. Case uses his organizational skills to create a strategy for the representation of his clients that is at the same time aggressive and efficient. He works hard to make sure that every option to beneficially resolve disputes, pre-litigation, is explored to the client's benefit. However, Mr. Case's experience helps the client to understand the benefits and potential drawbacks of each option. This is achieved by Mr. Case maintaining continuous contact with clients in order to keep them constantly informed of the status of their matters. If a matter cannot be resolved without litigation, Mr. Case's experience again helps achieve his client's objectives. Mr. Case has successfully resolved matters through formal mediation, trial, and binding arbitration. Throughout the process, Mr. Case continues to keep his client updated and involved in the process.
Significant Matters
Mr. Case has successfully handled various complex matters, including (a) binding arbitration defense of alleged construction defect claims (b) negotiating and appearing before Board of County Commissioners on behalf property owners, (c) opposing claims by the U.S. Department of Revenue for past due taxes on real estate, (d) pursuing the recovery and liquidation of large-items used as collateral for various commercial loans on behalf of bank clients, and (e) successfully representing a banking client to defeat claims filed under the Magnusson-Moss Warranty Act.
Community Involvement
Mr. Case is a member of the Orange County Bar Association. He is also certified to provide title insurance through Old Republic National Title Insurance Company. Mr. Case is an active member of the Board of Directors for MicheLee Puppets, a long-standing not-for-profit organization dedicated to giving youth the necessary tools to meet life's challenges and provide motivation to make meaningful contributions to society through puppetry arts.
