David M. Burkholder graduated magna cum laude both from Widener University School of Law, in 2002, and from Millersville University of Pennsylvania, in 1999.

Mr. Burkholder is an experienced litigator who has tried various matters in courts and before arbitration panels all over the country.

He has handled many cases, including commercial, construction, surety, securities and criminal-related litigation for individuals, non-profit entities and large and small corporate clients.

By way of example, he has represented owners, contractors, subcontractors and sureties in construction disputes involving claims for delay, poor workmanship, design errors, liquidated damages, mechanics’ liens, change orders, lost productivity, performance bond claims, payment bond claims and indemnity claims. Mr. Burkholder also has handled a wide array of commercial disputes, including the dissolution of partnerships, breach of fiduciary duty actions, fraud claims and regulatory enforcement proceedings involving for profit and not for profit entities.

He has represented financial institutions and broker dealers against claims of fraud, churning, unauthorized trading and unsuitability both in courts and before NASD arbitration panels; and he has represented insurers in a variety of claims, including coverage and bad faith disputes.

In the 2008 and 2011 editions of Super Lawyers, Mr. Burkholder was named a “Rising Star,” an honor received by only 2.5% of Pennsylvania lawyers each year.

From 1992 to 1997, Mr. Burkholder served in the United States Navy as a Persian-Farsi linguist, working in military intelligence and deploying to national and international military units operating in the Persian Gulf. During law school, Mr. Burkholder worked for the Chief Counsel of the Pennsylvania State Police Chief where, as a certified legal intern, he represented the State Police Commissioner in various administrative hearings and also analyzed pending legislation, including the Confidence in Law Enforcement Act. Prior to joining Powell Trachtman Mr. Burkholder was a member of the Litigation Practice Group of a major Philadelphia-based law firm.

Mr. Burkholder is admitted to practice in all Pennsylvania courts, the United States District Courts for the Eastern District of Pennsylvania, the Middle District of Pennsylvania, Colorado and the Third Circuit.
