James P. Bonner is a cum laude graduate of Harvard Law School (1992) and a summa cum laude graduate of Rutgers University (1989).  Mr. Bonner represents both plaintiffs and defendants in litigations and arbitrations venued throughout the country.  He has served as lead plaintiffs’ counsel in numerous large, complex securities and common law fraud actions and many litigations involving alleged violations of consumer protection statutes, the antitrust laws and unlawful trade practice statutes.  Mr. Bonner also frequently serves as counsel for entrepreneurs, venture capital firms and large investors in significant matters arising from alleged breaches of merger agreements and product development agreements and in cases involving securities fraud and other business torts.

Mr. Bonner has played a principal role in a number of significant securities fraud litigations prosecuted by Stone Bonner & Rocco LLP (“SBR”).  He served as lead counsel for the plaintiffs in In re Lernout & Hauspie Speech Products, N.V. Securities Litigation, a class action that has resulted in total recoveries for the class in excess of $180 million.  At the time of the Lernout settlements, the recoveries included the third-largest ever settlement with an auditing firm, the sixth-largest settlement ever in a litigation involving a bankrupt issuer and a $60 million recovery against a European bank in connection with an innovative liability theory related to SEC Rule 10b-5(a) and (c).  Mr. Bonner also represented a number of New Jersey public pension funds in In re Tyco Securities Litigation, where SBR secured settlements totaling $85 million for its institutional investor clients, a recovery that represented a multiple of more than 50 times the amount those funds would have achieved had they participated in the settlement in the related class action.  Mr. Bonner has also played a principal role in: In re Dreyfus Aggressive Growth Mutual Fund Litigation, a securities class action brought on behalf of investors in two Dreyfus mutual funds that resulted in a $20.5 million settlement that amounted to over 90% of class members’ claimed damages; In re Winstar Communications Inc. Securities Litigation, a securities class action that has resulted in over $30 million in partial settlements, including a substantial recovery secured in connection with the pursuit of innovative claims brought against a business partner of a securities issuer; In re CyberGuard Securities Litigation, a $10 million settlement that resulted in the collection of approximately 90% of the damages claimed by class members; In re Coram Healthcare Securities Litigation, a federal securities fraud class action that resulted in a recovery of over $49 million for the class, one of the largest recoveries ever achieved in the District of Colorado; J/H Real Estate v. Abramson, a securities fraud class action that resulted in a $22 million settlement on behalf of U.S. Healthcare investors, one of the largest settlements ever in a securities fraud class action prosecuted in the Eastern District of Pennsylvania; and Shaw v. Digital Equipment Corp., a securities fraud class action in which the United States Court of Appeals for the First Circuit reversed the lower court’s decision dismissing the plaintiffs’ complaint, thereby strengthening the disclosure obligations imposed upon corporations and underwriters in the context of public offerings.

Mr. Bonner has also taken a leading role in connection with many of the class actions in which SBR has represented consumers.  The consumer class actions in which Mr. Bonner has played a principal role include: Baird v. Thomson Consumer Electronics, Inc., an action brought on behalf of purchasers of certain RCA and Proscan televisions in which SBR obtained a 100% recovery for any repair costs that consumers incurred as a result of the defects alleged by the plaintiffs as well as certain enhanced warranty benefits; Argyropoulos v. HomEq Servicing Corp., where SBR obtained 100% refunds of the late fees paid by certain class members on their mortgage payments and 65% refunds of the late fee payments made by the remaining class members; and Heller v. Circle K Stores, Inc., where SBR secured preliminary and final injunctions prohibiting the defendant from imposing certain taxes upon class members.

Mr. Bonner has also served as New York counsel for hundreds of Americans, Israelis and other foreign citizens victimized by acts of terrorism committed in Israel and the Palestinian Territories.  Those cases involve claims that multiple international banking institutions have violated the Anti-Terrorism Act and the Alien Tort Claims Act by knowingly providing banking services to terrorist organizations.

In addition to his work on behalf of plaintiffs in the foregoing matters, Mr. Bonner regularly represents corporations, venture capital firms, investment funds, entrepreneurs and other individuals in a variety of commercial litigations and arbitrations.  Recent commercial litigation and arbitration matters in which Mr. Bonner has served as counsel include:

  • Representing the former shareholders of a start-up medical device company in an arbitration involving claims that a large, public company failed to fulfill its contractual obligation to develop the plaintiffs’ innovative product for use in connection with stenting procedures;
  • Pursuing securities fraud, suitability and breach of fiduciary duty claims on behalf of companies that invested in auction rate securities that failed at auction, leaving investors holding illiquid securities with minimal value;
  • Defending one of New York’s largest telecommunications contractors in an antitrust action involving alleged efforts to monopolize the market for the installation of telecommunications equipment and wiring in New York City;
  • Representing venture capital funds, entrepreneurs and other former shareholders of a start-up pharmaceutical company that sold a promising product to a large, public corporation that allegedly failed to fulfill post-sale obligations to develop the sellers’ product for commercial purposes;
  • Pursuing claims on behalf of a subsidiary of one of the world’s largest telecommunications companies related to the failed design and implementation of a complex billing system by a software company and a consulting firm; and
  • Defending claims asserted by the limited partners of real estate partnerships against the mezzanine lenders who financed failed commercial real estate projects.
