Mr. Bhatheja is a litigator and an advisor. Throughout his practice, he has represented a wide variety of corporate, insurance and individual clients in business and personal disputes including breach of contract, tortious interference with contract, personal injury tort litigation, fraud, alleged Truth in Lending Act violations, FINRA (f/k/a NASD) compliance and violations, and intellectual property disputes. Mr. Bhatheja has successfully counseled clients on how to avoid disputes and also how to resolve them once they arise. He has represented clients from small businesses such as car dealerships in consumer complaints to multinational companies in insurance coverage, insurance defense and insurance subrogation matters. Some of Mr. Bhatheja's representative matters include:
- Represented defendant insured and insurance company in defamation and false light claims by an independent marketing executive against a network marketing company (MLM company). (Judgment in favor of defendant resulting from Motion for Summary Judgment on all claims.)
- Represented defendant, a private telecommunications company, in a dispute with a competitor that involved breach of contract, unjust enrichment, and unfair competition. (Resolved prior to trial.)
- Represented defendant, real estate holding company in breach of contract action alleging non-payment of commissions to real estate broker, unjust enrichment, and fraud. (Resolved prior to trial.)
- Represented defendant, a Financial Advisor in a customer dispute in which the customer alleged non-suitable investment recommendations, fraud and breach of fiduciary duty. (Defense verdict after 4-day FINRA/NASD arbitration.)
- Represented plaintiff, a farmer in a breach of contract action against a customer for non-payment (Verdict for plaintiff at the close of arbitration).
- Represents professionals in employment contract negotiations and litigation of non-competition agreements in disputes that turn on whether the restrictive covenants in the agreements are reasonable in scope.
- Represents employers in wage complaints asserted by employees under A.R.S. 23-355.
- Represents property owners and tenants in commercial and residential landlord-tenant disputes, including forcible entry and detainer actions (i.e., eviction), commercial lock-outs and lease negotiations.
- Represents property owners and lenders and provides counsel regarding provisions of Arizona's residential and commercial real estate laws, including anti-deficiency provisions, and foreclosure or trustee's sales resulting from default on mortgages and/or deeds of trust.
Anoop Bhatheja earned his Juris Doctor from the University of Wisconsin in 2003 where he was a Managing Editor of the Wisconsin International Law Journal and a member of the Student Bar Association. During law school, Mr. Bhatheja was awarded the Abe Sigman law prize for his scholarship and service related to the Consumer Law Litigation Clinic. He also served as an intern for the Hon. Robert DeChambeau of the Dane County Circuit Court in 2002. Mr. Bhatheja graduated magna cum laude and earned his bachelor's degree in Business Management from the University of Arizona in 2000.
