Thomas Berkman is a staff attorney in the Securities at WilmerHale. He joined the firm in 2006.

Practice

Mr. Berkman focuses his practice on issues of e-discovery. Specifically, he works with other attorneys, litigation technology project managers, and paralegals on teams that manage electronic and other documents in large cases and investigations. Attorneys on these teams take a leadership role in the document control process, systematically tracking documents from preservation to collection and through review and production. They work with e-discovery vendors and their review and analytical tools; review documents; train and oversee other firm and contract attorneys who review documents; and partner with project managers to perform production quality control.

Mr. Berkman has direct experience representing clients in regulatory investigations, internal corporate investigations, and civil litigation. He has represented publicly traded companies and financial services firms with issues related to mutual fund market timing, late trading, revenue sharing, directed brokerage, transfer agency practices, initial public offering practices, corporate accounting practices, possible violations of the Foreign Corrupt Practices Act, real estate disputes and stock options.

From 2005-2006, Mr. Berkman was a contract attorney with firms in the Washington, DC area, including WilmerHale. Before his contract work, Mr. Berkman was an associate with an international firm in New York City, where he worked on a range of litigation, including matters involving trademark infringement, contract disputes and administrative proceedings concerning issuance of environmental permits.

From 1997-2003, Mr. Berkman served as an Assistant District Attorney for the Queen's County District Attorney's Office, working with both the Trial Division and Appellate Bureau. In the Trial Division, Mr. Berkman prosecuted a range of felony cases including sale of narcotics, attempted murders, robberies, burglaries and forgeries. While with the Appeals Bureau, he argued before the Appellate Division of the New York Supreme Court, the New York State Court of Appeals and the United States Court of Appeals for the Second Circuit.
