Michael Bednarek is a partner in AVH's Intellectual Property Group. Mr. Bednarek began his career in the IP field as a patent examiner in 1982. Since then, he has earned a reputation as a world-class IP strategist who knows how to align IP management and value creation with overall business strategy. Mr. Bednarek uses a unique combination of broad technical expertise, intimate familiarity with Patent Office procedures, global collaboration with IP experts in other regions, licensing and litigation expertise to find creative, cost-effective solutions for clients. After nearly 30 years in the IP field, Michael Bednarek is best known for his expertise in three areas: 1) representing international clients in the information technology and software, consumer electronics, computer and automotive fields in intellectual property litigation in the United States; 2) representing many of the world's largest financial institutions in patent and other IP litigation; and 3) collaborating with other IP experts throughout the world on the design and implementation of transactions and enforcement efforts to further global IP strategies.
Prior to joining AVH, Mr. Bednarek was co-chair of Shearman & Sterling's intellectual property litigation practice. Mr. Bednarek has been lead counsel in dozens of patent and other intellectual property infringement cases before U.S. district courts, the International Trade Commission, and the U.S. Court of Appeals for the Federal Circuit. Mr. Bednarek also represents clients in trademark, copyright , trade secret matters and false advertising challenges before the National Advertising Division (NAD) and the National Advertising Review Board (NARB). He has also participated in proceedings in other countries. Mr. Bednarek's litigation experience encompasses technologies including flat panel display controller circuitry, light emitting diodes (LED); microprocessors, computer hardware, machine tools; electrodeposited copper foil technology, consumer products, electronic banking software, consumer banking equipment, financial transaction technology, interactive voice response systems, call center technology, safety circuitry for consumer products, mobile fabrication systems, telecommunications equipment, casino gaming systems, diesel engine technology, advanced automotive systems, bicycle components, consumer product manufacturing equipment, computer games and toys, among others. He also represents domestic and international companies in patent portfolio management and monetization in the fields of semiconductors, software, business methods, nanotechnology, telecommunications, electro-mechanical devices, and consumer electronics.

Mr. Bednarek has been on the leading edge of significant trends in the patent field for more than 20 years. As a patent examiner in the early 1980s, Mr. Bednarek examined some of the first software patents. After leaving the U.S. Patent and Trademark Office, Mr. Bednarek was an early proponent of patent protection in a variety of non-traditional sectors, first in the software area, then in financial services, retail, transportation and hospitality sectors. In 1999, Mr. Bednarek was selected as the only attorney among 200 participants in a seminal nanotechnology event -- the Foresight Institute's "Group Genius Weekend: Foresight for the Next 30 Years."
Mr. Bednarek is a frequent lecturer on a broad range of topics including intellectual property strategy for the financial services industry, ITC practice, global patent strategy, patent pools and IP protection in Asia. He has been invited to speak on intellectual property topics at conferences throughout Asia, North America and Europe. Mr. Bednarek is also the author of written works published in six continents, including articles on a wide variety of topics including studies on global patent strategy, global trademark strategy and the outlook for patents in the financial service sector. He is a contributing author (on the subject of intellectual property) to the treatise Clinical Evaluation of Medical Devices (Humana Press) and annual editions of Licensing Update (Aspen Publishers). Mr. Bednarek is a contributing author of several books on business method patents published in Japan. Mr. Bednarek has been engaged as an expert witness in the United States and abroad, has been quoted in leading national publications and has appeared on television as an expert in intellectual property law.
Mr. Bednarek received his engineering (B.S.E.) degree from Marquette University in 1982. He received his J.D. degree (with honors) from the George Washington University National Law Center in 1987 and was admitted to practice before the United States Patent and Trademark Office in 1986. Mr. Bednarek is a certified licensing professional (CLP). Mr. Bednarek is a member of the bars of the District of Columbia and Commonwealth of Virginia. He has also been admitted to practice before the United States Supreme Court, appeals courts, the Eastern District of Texas, the Eastern District of Virginia and other district courts throughout the United States.
