Michael Bednarek is a partner in AVH's Intellectual Property Group.  Mr. Bednarek began his career in the IP field as a patent examiner in 1982.  Since then, he has earned a reputation as a world-class IP strategist who knows how to align IP management and value creation with overall business strategy.  Mr. Bednarek uses a unique combination of broad technical expertise, intimate familiarity with Patent Office procedures, global collaboration with IP experts in other regions, licensing and litigation expertise to find creative, cost-effective solutions for clients. After nearly 30 years in the IP field, Michael Bednarek is best known for his expertise in three areas: 1) representing international clients in the information technology and software, consumer electronics, computer and automotive fields in intellectual property litigation in the United States; 2) representing many of the world's largest financial institutions in patent and other IP litigation; and 3) collaborating with other IP experts throughout the world on the design  and implementation of transactions and enforcement efforts to further global IP strategies.

Prior to joining AVH,  Mr. Bednarek was co-chair of Shearman & Sterling's intellectual property litigation practice.  Mr. Bednarek has been lead counsel in dozens of patent and other intellectual property infringement cases before U.S. district courts, the International Trade Commission, and the U.S. Court of Appeals for the Federal Circuit.   Mr. Bednarek also represents clients in trademark, copyright , trade  secret matters and false advertising challenges before the National Advertising Division (NAD) and the National Advertising Review Board (NARB).  He has also participated in proceedings in other countries. Mr. Bednarek's litigation experience encompasses technologies including flat panel display controller circuitry, light emitting diodes (LED); microprocessors, computer hardware, machine tools; electrodeposited copper foil technology, consumer products, electronic banking software, consumer banking equipment, financial transaction technology, interactive voice response systems, call center technology, safety circuitry for consumer products, mobile fabrication systems, telecommunications equipment, casino gaming systems, diesel engine technology, advanced automotive systems, bicycle components, consumer product manufacturing equipment, computer games and toys, among others. He also represents domestic and international companies in patent portfolio management and monetization in the fields of semiconductors, software, business methods, nanotechnology, telecommunications, electro-mechanical devices, and consumer electronics.

Recent lead counsel and other representative experience includes:

  • Represented leading automobile company in district court patent litigation (C.D. Cal) relating to software controls and diesel engine technology.
  • Represented leading automobile company in district court patent litigation (New Jersey) relating to driver drowsiness detection and warning.
  • Represented supplier of washable dry erase markers in NAD (National Advertising Division) proceedings challenging advertising claims.  NAD found that the advertising claims were substantiated.
  •  Represented international investment group in developing and implementing global strategy to stop internet fraud.  Action in the Southern District of New York included claims for false designation of origin, false representation, cybersquatting, deceptive trade practices and violations of the Lanham Act. 
  • Defended integrated circuit design company in district court patent infringement litigation (EDTX) involving "presnoop patents" owned by Opti, Inc. and technologies used on logic chipsets, motherboards and microcomputers.
  • Lead defense counsel in more than a dozen patent infringement actions filed in the Central District of California by Network Signatures, Inc. against a range of leading financial services institutions, transportation and consumer products companies.  The subject patent (licensed from the United States Government's  Naval Research Laboratories) relates to intermediate network authentication using cryptographic digital signatures based on asymmetric cryptography.
  • Defended a Japanese company in district court patent infringement litigation (Delaware) involving patents owned by Flashpoint Technology, Inc. relating to user interfaces on digital cameras and camera phones.  Case was settled on favorable terms.
  • Represented Taiwanese and Israeli suppliers of Trusted Platform Module (TPM) security chips in district court patent litigation brought by Quantum World in the Eastern District of Texas involving patents on random number generators asserted against personal computers.
  • Represented the leading provider of inter-carrier SMS and MMS messaging services in district court patent infringement litigation (E.D. Virginia) involving inter-carrier messaging services allowing messages to be sent to and from mobile phones on different carriers through an intermediary.
  • Represented the Taiwanese  supplier of  printer products accused of infringement in lawsuits by Screen Tone Systems Corporation and Acacia research in the Eastern District of Texas and Central District of California.  The subject patents relate to the use of dither arrays that are dynamically computed at run time or in response to a user-specified screen angle/frequency. Case voluntarily dismissed by plaintiffs.
  • Representing two Taiwanese manufacturers  in district court litigation (Delaware) involving digital camera technology and patents owned by St. Clair Intellectual Property Consultants, Inc.
  • Represented a Taiwanese respondent in an International Trade Commission (ITC) enforcement action under Section 337 involving mixed-mode integrated circuit controllers used in video displays.
  • Represented a Taiwanese respondent in Section 337 patent infringement action before the International Trade Commission (ITC) in a case involving three patents relating to mixed-mode integrated circuit controllers used in video displays.
  • Represented a domestic medical software company as plaintiff in district court patent infringement litigation (N.D. Georgia) involving a software engine having an adaptable driver for interpreting variables produced by a variety of sensors.
  • Represented a Taiwanese IC design house in proceedings, including an inter partes hearing, conducted by the U.S. Customs and Board Protection concerning a new display controller chip design, obtaining a determination that the newly-designed chips did not fall within the scope of an ITC exclusion order.
  • Defended domestic financial institutions in district court litigation involving call center technology patents, owned by Ronald A. Katz. Also, counseled more than ten other financial services companies and other companies regarding the Katz patent portfolio.
  • Represented, as plaintiff's counsel, a leading domestic financial services company in district court patent infringement litigation (E.D. Virginia) involving a system for remote distribution of financial services.
  • Defended a  leading domestic financial services company in district court patent infringement litigation  (E.D. Virginia)  involving methods for conducting financial transactions using an ATM network and debiting of user accounts in real-time.

Mr. Bednarek has been on the leading edge of significant trends in the patent field for more than 20 years. As a patent examiner in the early 1980s, Mr. Bednarek examined some of the first software patents. After leaving the U.S. Patent and Trademark Office, Mr. Bednarek was an early proponent of patent protection in a variety of non-traditional sectors, first in the software area, then in financial services, retail, transportation and hospitality sectors. In 1999, Mr. Bednarek was selected as the only attorney among 200 participants in a seminal nanotechnology event -- the Foresight Institute's "Group Genius Weekend: Foresight for the Next 30 Years."

Mr. Bednarek is a frequent lecturer on a broad range of topics including intellectual property strategy for the financial services industry, ITC practice, global patent strategy, patent pools and IP protection in Asia. He has been invited to speak on intellectual property topics at conferences throughout Asia, North America and Europe. Mr. Bednarek is also the author of written works published in six continents, including articles on a wide variety of topics including studies on global patent strategy, global trademark strategy and the outlook for patents in the financial service sector. He is a contributing author (on the subject of intellectual property) to the treatise Clinical Evaluation of Medical Devices (Humana Press) and annual editions of Licensing Update (Aspen Publishers).  Mr. Bednarek is a contributing author of several books on business method patents published in Japan. Mr. Bednarek has been engaged as an expert witness in the United States and abroad, has been quoted in leading national publications and has appeared on television as an expert in intellectual property law.

Mr. Bednarek received his engineering (B.S.E.) degree from Marquette University in 1982. He received his J.D. degree (with honors) from the George Washington University National Law Center in 1987 and was admitted to practice before the United States Patent and Trademark Office in 1986. Mr. Bednarek is a certified licensing professional (CLP). Mr. Bednarek is a member of the bars of the District of Columbia and Commonwealth of Virginia. He has also been admitted to practice before the United States Supreme Court, appeals courts, the Eastern District of Texas, the Eastern District of Virginia and other district courts throughout the United States.
