JOSH ARCHER has nearly two decades of experience in sophisticated commercial litigation, representing business and organizational clients in trial and appellate courts throughout Georgia.  His practice emphasizes resolving business tort and contract claims, defending product liability and personal injury allegations, and settling administrative law controversies for small privately owned companies and billion-dollar corporations alike. As the Managing Partner of Balch & Bingham’s Atlanta office, Josh directs a litigation team with capabilities to handle a variety of business disputes involving commercial, employment, intellectual property, professional liability and numerous other claims.

By encompassing state and federal courts and appellate panels throughout Georgia, Josh’s statewide practice is unique for an Atlanta-based litigator.  It means that his knowledge of judges and court procedures throughout the state are major plusses for his defense clients. Josh is equally experienced in the nuances of attitude and approach that are important to helping clients make informed strategy decisions.  Josh has an insightful judgment that makes him a consistent choice for national law firms and companies that need counsel in Georgia.

With his emphasis on business litigation Josh has resolved numerous commercial disagreements ranging from simple contract matters to complex transactional disputes.  He works with companies in many industries to ensure fulfillment of service agreements, manufacturing and supply contracts, and warranties. Such counseling includes claims alleging misrepresentation, and complex questions of contract interpretation, such as a buy-sell agreement involving a health care provider, contracting disputes for a major electric utility and intellectual property infringement litigation for recording companies. He has also defended companies against employee claims.

Josh has experience representing and defending companies in cases alleging injury from products that his clients designed, manufactured or sold.  Throughout Georgia he has defended companies that vary from a manufacturer of aircraft to small specialized producers of consumer and industrial goods such as lawn mowers. Josh brings to each of these cases a combination of trial and negotiating skill, case management sophistication, solid technical knowledge and strategies to defend his clients. 

In the area of administrative disputes, Josh represents business clients in their controversies with local and state governmental entities.  Typical points of contention include the issuing of licenses, securing certificates of need for health care clients, and handling condemnation matters.

Josh has been selected by his professional peers for inclusion in the general litigation category of Georgia SuperLawyers every year since 2009.  He is a member of the Georgia Chamber of Commerce board of directors, and is actively involved in the Chamber’s Law & Judiciary Committee.

Before joining Balch & Bingham’s Atlanta predecessor, Meadows Ichter & Trigg, Josh was a litigation associate on the toxic tort team at King & Spalding from 1996 to 1999. From 1994 to 1996 he served a judicial clerkship for the Honorable Alex T. Howard, Jr. of the United States District Court for the Southern District of Alabama.

Josh and his wife, Liz, live with their son, Jacob, and their daughter, Isabel, in Atlanta.
