Kevin Apollo is a member of Nelson Levine de Luca & Hamilton’s National Insurance Coverage Practice. His practice is focused primarily on complex insurance coverage cases, with particular emphasis on analyzing first-party property and third-party liability insurance issues. Mr. Apollo also has extensive experience defending clients in bad faith matters and professional malpractice liability cases.
During his career, Mr. Apollo has represented multiple insurers in a broad range of issues spanning climate change, business income loss, property loss, rescission and professional liability. His experience also includes extensive trial and appellate court writing, conducting depositions, providing courtroom advocacy, and engaging in motion practice in federal and state courts.
Representative Experience
- Represented building owners and managers of a high-rise commercial office building that caught fire and was ultimately demolished. Defended against property damage and business claims made by tenants and neighboring businesses.
- Conducted analyses of property damage and business interruption valuation issues for a domestic insurer involved in the World Trade Center Property Insurance Litigation, which involved attempts by commercial and retail leaseholders of the World Trade Center to recover insurance proceeds after September 11.
- Represented a major insurer in a coverage action brought by an oceanfront hotel and resort involving significant water and mold loss claims.
- Represented a domestic primary insurer in a major coverage litigation commenced by a nation-wide commercial insured seeking first-party insurance coverage for costs incurred to upgrade and remediate its computer systems in preparation for Y2K.
